Terms and conditions

Important – read carefully. The software maintenance and support agreement, which is contained in the software package delivered to you, is a legally binding agreement between you (the licensee) and Bruel & Kjaer EMS Pty Ltd. By utilizing the license(s) in the enclosed software maintenance and support certificate you are agreeing to become bound by these terms and conditions for software maintenance and support.

Terms and conditions of sale and supply. The Goods and all other products sold by the Seller are sold on the terms set out in these Conditions (which Conditions shall only be waived or modified in writing signed by the Seller). The Buyer shall be deemed to have accepted these Conditions upon the Buyer submitting an order to the Seller. Nothing in these Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Trade Practices Act 1974) and which by law cannot be excluded, restricted or modified.
